These Terms apply to all purchases made through www.vapestorm.co.uk and govern the relationship between Vapestorm LTD and the customer (“you”).

- on behalf of anyone under 18.
We reserve the right to cancel any order where age cannot be verified or where we suspect the order breaches age-restriction laws.

7. Ordering Process & Contract Formation
7.1 Placing an Order
When you place an order on our website, you will receive an automated confirmation email acknowledging receipt.
7.2 When the Contract Is Formed
The contract between you and Vapestorm LTD is formed only when your order is dispatched, not when the confirmation email is sent.
This protects both parties in the event of:
- stock errors,
- pricing mistakes,

7.3 Price Errors
If a product is listed at an incorrect price, we reserve the right to:

- or contact you to offer alternatives.
You will receive a full refund if cancelled.

7.5 Fraud Prevention, Chargebacks & Payment Reversals (NEW)

- a previous chargeback or disputed payment exists on the customer’s account.
If a chargeback is filed after goods have been dispatched or delivered, Vapestorm LTD may pursue recovery of the goods or legal action to reclaim the owed amount.

9.2 Delivery Issues
Risk of loss transfers to you only upon delivery, not dispatch.
If a parcel is lost or delayed, we will assist in tracking and resolving the issue.
9.3 Delivery Delays
While we make every reasonable effort to deliver within the stated timeframes, Vapestorm LTD is not liable for delays in delivery, including those caused by Royal Mail, strikes, seasonal backlogs, or other factors outside our control.
Your statutory rights regarding undelivered goods remain unaffected.
9.4 Cross-Border Orders (NEW)
Vapestorm LTD supplies products exclusively within the United Kingdom.
Orders placed from outside the UK—whether intentionally, via forwarding services, or using VPN/foreign IP—may be automatically cancelled and refunded.
We accept no responsibility for shipments redirected outside the UK after delivery.
10. Returns, Refunds & Right to Cancel (Cooling-Off Period)
10.1 Cooling-Off Period
In accordance with UK consumer law, you have a statutory 14-day right to cancel your order from the day you receive your goods, without giving any reason.
During this 14-day period you may inspect the goods only to the extent necessary to determine their nature, characteristics and functioning, in the same way you would be allowed to examine them in a physical retail store.
You must not open, unseal, fill, install, charge, insert batteries, use, activate or otherwise operate any item during this period.
Any such action will be treated as use of the product, and your right to cancel may be lost or reduced due to diminished value, in accordance with consumer law.
These items cannot be returned for a refund unless faulty.

To exercise your statutory right to cancel, you must notify us within 14 days of receiving your goods by emailing:

10.2 Hygiene Exceptions – No Returns on Opened Items
Due to hygiene and safety regulations, we cannot accept returns of:
- opened e-liquids
- used or opened devices
- opened coils, pods, tanks
- any product where tamper seals have been broken
These items cannot be returned for a refund unless faulty.
10.3 Return Costs
- If the product is faulty, we pay return shipping.
- If you change your mind or order the wrong item, you pay return shipping.
10.4 Refund Timeframe
Refunds will be issued as soon as possible (typically within a few working days), always within the legal maximum of 30 days.
Refunds are always made to the original payment method.
10.5 Acceptance of Goods When Opened or Used
Opening or using a product will generally be treated as acceptance of the goods, except where a fault becomes evident during normal use. This does not affect your statutory rights under the Consumer Rights Act 2015.
If you believe an incorrect item has been sent, please do not open or use it, as this may limit the remedies available. If the issue is reported before use, we will be able to arrange a replacement or refund more efficiently.
This includes situations where:
- a wrong flavour, nicotine strength, colour or model was received, but the product was used before notifying us;
- the customer failed to review packaging or labelling prior to use.
This clause does not affect your statutory rights.
11. Warranty – Statutory Consumer Rights Only
11.1
Vapestorm LTD does not provide any additional retailer warranty on any products sold. All warranty rights arise exclusively from the Consumer Rights Act 2015.
11.2
If a product is faulty, you are entitled to the following statutory rights:
- 30-Day Short-Term Right to Reject
You may reject faulty goods within 30 days of receiving them and request a full refund. - 6-Month Reversal of Burden of Proof
If a fault develops within the first 6 months, it is legally presumed to have been present at the time of delivery unless we can prove otherwise. During this period, you are entitled to repair or replacement. If repair or replacement is not possible or not successful, you are entitled to a refund.
11.3
After the initial 6-month period, faults are assessed according to reasonable durability as defined by the Consumer Rights Act 2015. This takes into account the type of product, its expected lifespan and its intended use. Any long-term defects may fall under the responsibility of the manufacturer according to their own warranty scheme.
Vapestorm LTD acts solely as a retailer and does not manufacture or alter any products sold. Our responsibility is limited to the statutory consumer rights required under UK law; all long-term or manufacturing-related defects fall under the responsibility of the product’s manufacturer.
11.4
Consumable items such as coils, pods, and disposable vape devices have naturally limited lifespans. Issues related to normal wear and tear, personal usage habits, or end-of-life performance do not constitute a manufacturing fault.
11.5
Vapestorm LTD is not responsible for faults caused by:
- misuse or improper handling;
- incorrect installation;
- the use of incompatible or unapproved chargers and accessories;
- modifications, tampering or opening a device;
- physical damage, drops or liquid exposure;
- general wear and tear.
11.6
Your statutory rights remain unaffected. Nothing in these Terms limits the protections you are entitled to under UK consumer law.
12. Battery Safety Disclaimer
You agree to follow all lithium battery safety warnings supplied with your purchase.
12.1
Lithium-ion batteries can be dangerous if mishandled. By purchasing any battery, device or product containing a battery from Vapestorm LTD, you agree to use it in accordance with the safety instructions provided by the manufacturer and those listed in these Terms.
12.2
Vapestorm LTD is not responsible for any damage, loss, injury or incident resulting from:
- misuse of the battery or device;
- improper charging practices;
- using unapproved, incompatible or faulty chargers;
- leaving batteries unattended while charging;
- physical damage (including drops, crushing or punctures);
- liquid exposure;
- incorrect installation of batteries or coils;
- attempting to modify, open, rebuild or tamper with a device;
- using batteries that are worn, damaged or have torn wraps;
- failure to store or transport batteries safely.
12.3
You must never leave batteries charging unattended, including overnight or when leaving the premises. Batteries should only be charged on non-flammable, heat-resistant surfaces and with chargers recommended by the device manufacturer.
12.4
If a battery becomes hot, swollen, damaged, or begins to behave unusually, discontinue use immediately and dispose of it safely in accordance with local regulations.
12.5
Your statutory rights under the Consumer Rights Act 2015 remain unaffected.
13. Limitation of Liability
13.1
Nothing in these Terms shall exclude or limit our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any rights you are entitled to under UK consumer law, including the Consumer Rights Act 2015.
13.2
Vapestorm LTD acts solely as a retailer and does not manufacture, modify or alter any of the products sold on this website. All products are supplied to us already manufactured and compliant with UK regulations.
13.3
After the statutory period described in Section 11, faults are assessed based on reasonable durability and may fall under the responsibility of the product’s manufacturer. We may assist in directing you to the appropriate manufacturer or warranty provider, but Vapestorm LTD is not liable for defects that arise outside of your statutory consumer rights.
13.4
We are not liable for any loss or damage arising from:
- improper or unsafe use of products;
- failure to follow manufacturer or safety instructions;
- using incompatible or unapproved chargers or accessories;
- physical damage, liquid exposure or incorrect installation;
- third-party actions or circumstances beyond our control;
- indirect, incidental or consequential losses, including loss of profit or data.
13.5
Your statutory rights remain unaffected. Nothing in these Terms is intended to limit your legal protections as a consumer under UK law.
13.6 No Liability for Delivery Delays
Vapestorm LTD is not liable for financial, consequential or indirect loss arising from delays in delivery, including lost time, missed events or business interruptions.
This does not affect your statutory rights regarding non-receipt of goods.
14. Force Majeure
We are not liable for delays or failure to deliver caused by events outside our reasonable control, including:
- strikes (including Royal Mail)
- natural disasters
- power outages
- cyber attacks
- war or terrorism
- government restrictions
15. Age Verification Policy (Full Section)

We use a third-party age-verification service, including AgeChecked, to confirm that you meet the minimum legal age requirement. By proceeding with your purchase, you consent to your information being shared with AgeChecked and any identity-verification partners they work with solely for the purpose of verifying your age under UK age-restriction regulations.
15.4
AgeChecked operates as an anonymised verification platform and does not store your personal details beyond what is necessary to complete the verification. They do not track your browsing activity, and any data processed is handled securely and retained only as long as required by law and for future verification checks. 15.5
If automatic verification via AgeChecked is unsuccessful, your order may be placed on hold. In these cases, we may contact you by email to request manual ID verification, such as a clear photograph of a valid passport, driving licence or other acceptable proof of age.
15.6
If you choose not to provide the requested information, or if we are unable to verify your age using either automatic or manual methods, we reserve the right to cancel and refund your order in full.
15.7
If age verification fails repeatedly or you do not respond to our verification request, your order may be cancelled without further notice.
15.8
Where required, and only for orders containing age-restricted goods, delivery may be completed using Royal Mail Tracked Age Check Delivery or another courier requiring a valid ID upon delivery. Failure to present valid ID at the time of delivery will result in the parcel being returned, and your order may be cancelled and refunded minus any delivery charges.
15.9
If you experience difficulty completing the verification process, please check your email inbox (including spam or junk folders) for a verification link from AgeChecked. Once verified, your order will be processed normally. Future orders may not require re-verification, provided your details remain the same and you are logged into your account at the time of purchase.

19. Product Verification Before Use (Customer Responsibility)
19.1
Before using any device, e-liquid, disposable, coil, battery or accessory purchased from Vapestorm LTD, you are responsible for checking that the correct product, flavour, nicotine strength, variant, colour, model and quantity has been delivered.
19.2
If you believe that an incorrect item has been sent, you must not open, fill, charge, install, vape or otherwise use the product.
Opening or using an incorrect item may prevent us from being able to inspect it and may affect your eligibility for a replacement or refund.
19.3
Vapestorm LTD cannot accept liability for any issue, damage, reaction or loss arising from the use of a product that was not checked before use, including situations where the customer:
- used a product with incorrect flavour or strength,
- used a product they did not order,
- failed to review packaging or product labelling before use,
- opened or used a product before notifying us of an error.
19.4
If an incorrect item has been received, please contact us immediately before opening or using the item so that we can arrange a replacement or refund in accordance with our Returns Policy.
19.5
This clause does not affect your statutory rights under the Consumer Rights Act 2015.
19.6 Acceptance of Goods by Use
Using, opening, filling, charging, or otherwise activating a product before reporting an issue will be considered acceptance of the goods, meaning:
- the product is considered delivered as described,
- refund/replacement may be limited unless a manufacturing defect is proven.
Your statutory rights remain unaffected.
20. Severability Clause

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be deemed removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
